Nuevos horizontes - New Horizons

En tiempos de intuir nuestros nuevos horizontes se me ocurre pensar en Colombia, un país que posee récords importantes en algunos aspectos cuestionados: el maltrato a las mujeres(1), el desplazamiento interno, la explotación de niños, niñas y adolescentes, ser el segundo proveedor en el mundo, después de Rumania, de modelos para las páginas Webcam,…(2)

La página webcam es una plataforma tecnológica que permite que se conecten para chatear quienes pagan por usar sexualmente a las personas y modelos (mujeres que se desnudan, solas o acompañadas, para entretener a través de computadora y cámara). Estas conexiones se realizan desde estudios que poseen herramientas tecnológicas súper-rápidas en internet y plataformas de pago que permiten hacer transacciones con tarjeta crédito o en moneda virtual para que los demandantes cancelen los “servicios” que solicitan.

La realidad social del país, ligada a la desigualdad, la pobreza, la dificultad para acceder a la educación superior, la escasez de oportunidades, el desempleo, lleva a jóvenes violadas, extorsionadas, tratadas, de escasos recursos, estudiantes que necesitan trabajo o jóvenes que desean alcanzar independencia financiera, a dedicar 6 u 8 horas diarias a esta “actividad”.

El auge en Colombia es tan grande (se estima más de 20.000 mujeres a diciembre 2017 y más de 35.000 personas dedicadas a esta “actividad” en diciembre 2018), que ya existe en Medellín una universidad que brinda a las aspirantes, herramientas de persuasión, seducción, posturas corporales, ajuste de ángulos, creatividad. La persona debe aceptar que no está haciendo nada malo, que está vinculada al entretenimiento de adultos, ser coqueta, divertida, saber posar frente a las cámaras.

Ya hay numerosas historias de mujeres que han tenido que acostarse con los productores de los estudios, otras han sido golpeadas, abusadas, esclavizadas, extorsionadas, chantajeadas, obligadas a tener relaciones sexuales frente a la cámara, con riesgos grandes en términos de seguridad física, emocional e íntima y explotación sexual(3).

Aunque los que les ofrecen esta forma de ingresos afirman que no es prostitución porque nadie las toca, sólo se disfrazan y hacen shows para enamorar a sus seguidores, algunas personas afirman que es algo denigrante, lo catalogan como prostitución; otras aseveran que es una modalidad de abuso sexual; que es una prostitución disfrazada, más elitista, no la que se para en la calle; que los estudios webcam son la puerta de entrada para las víctimas de delitos sexuales y ser modelo webcam es una nueva forma de explotación sexual. Esas imágenes se utilizan para luego forzarlas, amenazarlas y explotarlas en la prostitución.

En Colombia las webcam a pesar de ser una práctica entre lo legal y lo ilegal, no está reglamentada por las autoridades pero la Ley 1943 de 2018, denominada Ley de financiamiento, en el Artículo 65 que adiciona un parágrafo al Art. 368 del Estatuto Tributario -E.T(4), establece el impuesto al negocio de la pornografía a través de las webcams, quedando una pregunta planteada: ¿A través del impuesto a este negocio sexual se está dando status/aprobación a una práctica aceptada?

Finalmente agregar que esta “actividad”, sin profundizar en los aspectos espiritual y sicológico, tiene efectos nocivos en la lucha por los derechos de la mujer porque reproduce valores negativos de la libertad y el uso del cuerpo; resulta además fácil de evidenciar la relación que puede existir entre los estudios sin control con los delitos de trata de personas con fines de explotación sexual y la pornografía infantil (en Ibagué encontraron un estudio con menores de edad), entre otros.

New Horizons

In times of having the intuition of our new horizons, it occurs to me to think of Colombia, a country that has important records in some questioned aspects: the mistreatment of women,(1) internal displacement, exploitation of children and adolescents, being the second provider in the world, after Romania, of models for Webcam pages...(2)

The webcam site is a technological platform that allows those who pay to use people and models sexually (women who undress, alone or accompanied, to entertain through computer and camera) These connections are made from studios that have super-fast technological tools on the internet and payment platforms that allow transactions with credit card or virtual currency so that applicants pay for the "services" requested.

The social reality of the country, linked to inequality, poverty, difficulty in accessing higher education, lack of opportunities and unemployment, leads to raped young girls, extorted, trafficked, poor, students who need a job or young people who want to achieve financial independence; to dedicate 6 or 8 hours a day to this "activity".

The boom in Colombia is so great (an estimation of more than 20,000 women as of December 2017 and more than 35,000 people dedicated to this “activity” in December 2018), that there is already a university in Medellin that provides applicants with persuasion tools, seduction, body postures, angle adjustment and creativity. The woman must accept that she is not doing anything wrong, acknowledging to be linked to adult entertainment, to be flirtatious, funny, to know how to pose in front of the cameras.

There are already many stories of women who have had to sleep with the producers of the studios, others have been beaten, abused, enslaved, extorted, blackmailed, forced to have sex in front of the camera, with great risks in terms of physical safety, emotional and intimate and sexual exploitation.(3)

Although those who offer them this form of income affirm that it is not prostitution because nobody touches them, they only dress up and do shows to make their followers fall in love, some people ratify that it is something degrading, they classify it as prostitution. Others assert that it is a form of sexual abuse; that it is a disguised prostitution, more elitist, not the one that stands in the street. Claiming that webcam studios are the gateway for victims of sexual crimes and being a webcam model is a new form of sexual exploitation. These images are then used to force, threaten and exploit them in prostitution.

Webcams in Colombia, despite being a practice between the legal and the illegal, are not regulated by the authorities. Law 1943 of 2018, called Financing Law, in Article 65 that adds a paragraph to Art. 368 of the Tax Statute -ET,(4) establishes the tax on the pornography business through webcams, leaving a question posed: Through the tax on this sexual business, is status / approval being given to an accepted practice?

Finally, point that this "activity", without delving into the spiritual and psychological aspects, has harmful effects on the fight for women's rights because it reproduces negative values of freedom and the use of the body. It is also easy to prove the relationship that may exist between uncontrolled film studios with the crimes of people trafficking for the purpose of sexual exploitation and child pornography (In Ibagué they found a film studio with minors), among others.
